Terms of Sales

The purpose of these general terms and conditions of sale (GTC) is to inform visitors to the kalinkashop.fr site of the terms under which Kalinka-Klub proceeds with the sale, delivery and collection of products ordered from the site.
They apply to sales contracts concluded between customers of the kalinkashop.fr e-commerce site and the Kalinka-Klub company, whose identity is as follows:
 

These T&Cs define the rights and obligations of the parties in connection with the sale of products by Kalinka-Klub to the consumer. They apply, without restriction or reservation, to all sales made by Kalinka-Klub of products offered on its website.

The order of products presented on the Kalinka website is subject to the customer's acceptance of all of the GCS set out below, which the Buyer acknowledges having read prior to his order.
The items offered on kalinkashop.fr are intended for private customers, therefore, the buyer, prior to his order, declares that the purchase of a product on the Kalinka-Klub website is not directly related to personal use and is limited to strictly professional use.
Kalinka-Klub reserves the right to modify these T&Cs at any time.

Article 1 – Acceptance of the GCS
The fact, for a user, to confirm his order and communicate his bank details for payment purposes, is worth full and complete acceptance of these GCS and this whatever the delivery address of the products or the means of payment used.

 Article 2 – Orders
The order is made by the customer by clicking on the "Place order" button when displaying the basket summarizing all the conditions of sale and the payment of the price. The click made by the customer on the "Place order" button constitutes confirmation of his order and acceptance of the GCS.
Beforehand, the customer must be identified after opening an account on kalinkashop.fr. When opening an account on kalinkashop.fr, the customer agrees to enter only valid information.
The order is only final after the payment phase has been successfully completed. A summary of the order is then sent to the customer on his email address and can be consulted in the “My account” section on the kalinkashop.fr website.
Kalinka reserves the right to cancel any order from a customer with whom there is a dispute relating to a previous order. Delivery can only be made to the address indicated by the customer when entering his order. The information provided by the customer when taking the order commits the latter and the seller cannot be held responsible for the impossibility in which it could be to deliver the product in the event of an error, in particular in the contact details of the recipient.

 Article 3 – Products
The photos of the products are presented on the kalinkashop.fr site for information purposes. However, suppliers are often led to modify their articles often to improve their quality. Therefore these photos can not be considered as contractual and any variations can in no way affect the validity of the sale.

 Article 4 – Price
The prices indicated on the kalinkashop.fr site are in Euros, all taxes included, excluding delivery costs and are subject to change during the year. It is understood that the products ordered are invoiced at the price in effect when the order is validated.
The products remain the entire property of Kalinka-Klub until full receipt of the entire invoice.

 Article 5 – Availability
The offers offered on kalinkashop.fr are valid within the limits of available stocks. In case of unavailability of the product after the confirmation of the order, the customer will be informed by email within 24 working hours. A waiting period for receipt of the unavailable product will be provided.

 Article 6 – Delivery
The delivery of the products is done by Letter Followed without signature via La Poste. For reasons of the size or value of the Parcel the letter followed can be replaced by Colissimo against signature free of charge. Delivery is made in metropolitan France, Monaco and internationally. These means of delivery guarantee a delivery time of around 2 to 3 working days and up to 5 days internationally.

In order to avoid any disputes, in the event of common mailboxes or doubts about deliveries without signature, please choose to send by COLISSIMO AGAINST SIGNATURE. Kalinka-Klub is not responsible for delays in delivery caused by the post office or loss of parcels.

The customer must check the general condition of the package upon receipt. If the products were damaged, it is advisable to refuse the delivery, Kalinka-Klub will take care of sending another delivery in replacement. The customer undertakes, for his part, to issue written reservations on the carrier's delivery note and to inform Kalinka-Klub by e-mail within 24 hours at the address contact@kalinkashop.fr

Orders are shipped from Monday to Friday inclusive. Any order placed before 2.00 p.m. is dispatched the same day or the next day, with the exception of orders placed on Friday after 2.00 p.m., Saturday and Sunday, which are dispatched the following Monday. Kalinka-klub retains the right to prepare the order for up to 24 hours if necessary.
This being the case, in any event, exceeding delivery times by post cannot give rise to damages or cancellation of the order.
Any complaint made beyond 1 month after order will not be admissible. It is therefore imperative to notify us of any package not received within this period.
In addition, the reshipment will be the responsibility of the customer for any delivery not received due to an incorrect or insufficient address.

Article 7 – Payment
Payment is made by secure online transaction in cash by credit card at the time of the order. The customer accepts in advance and without reservation that Kalinka-Klub proceeds with the secure transaction.
The order will only be considered final when the bank payment centers concerned have given their agreement. In case of refusal, the order will be automatically cancelled.
Kalinka reserves the right to subsequently cancel any order from a customer with whom there is a dispute.

Article 8 – Right of withdrawal
In accordance with Article L121-16 of the Consumer Code, the customer has a withdrawal period of 7 working days from the day of delivery of the goods ordered.

The shipping and return costs will then be borne by the customer. Only the price of the product(s) purchased will be refunded. The products must be returned new, in their original packaging, unopened, unused, complete (accessories, instructions, etc.) and accompanied by a copy of the invoice. Items returned open, incomplete, damaged, damaged or soiled by the customer will not be taken back.
Reimbursement of products will be made within 10 days from the date of receipt at Kalinka-Klub provided that no anomaly is found.
In the event of abnormal or abusive returns, Kalinka-Klub reserves the right to refuse a subsequent order.

 Article 9 – Disputes
Kalinka-Klub cannot be held liable for damages of any kind, whether material, immaterial or bodily, which could result from the misuse of the products marketed. The same applies to any modifications to the products resulting from the manufacturers.

The responsibility of Kalinka-Klub will, in any event, be limited to the amount of the order. In the event of a dispute, an amicable solution will be favored by Kalinka-Klub and the customer. Otherwise, the Commercial Court of Nice will have sole jurisdiction, regardless of the place of delivery and the method of payment used by the customer.

This agreement is subject to French law.
